13) Governing Law; Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Except as provided in the Arbitration section below, you agree that any disputes will be brought in state or federal courts located in Somerset County, New Jersey, and you consent to jurisdiction and venue there.

14) Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. It affects how disputes are resolved.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules and procedures, before a single arbitrator.

No class actions. Arbitration will be conducted on an individual basis only. The arbitrator may not consolidate claims or preside over any form of class, collective, or representative action.

Location. The arbitration location will be determined under AAA rules, in a manner reasonably convenient for you, unless otherwise agreed.

Governing law. The arbitrator will apply New Jersey law consistent with the Federal Arbitration Act.

If any portion of this Arbitration section is found unenforceable, the remainder will remain in effect except that if the class action waiver is found unenforceable, this entire Arbitration section will be null and void.

15) Waiver of Jury Trial

To the extent permitted by law, you waive any right to a jury trial for disputes related to these Terms or the Website.

16) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

17) Entire Agreement

These Terms (together with the Privacy Policy and any other policies posted on the Website) constitute the entire agreement between you and ERIKRENNINGER.COM regarding the Website and supersede any prior agreements or understandings.
